Powered Games Athlete Participation waiver

Event Organiser: Barker Health & Wellness Studios Pty Ltd trading as EmpoweredHQ (“EmpoweredHQ”)

I understand that the Powered Games is a functional fitness competition involving strenuous physical activity. Activities may include, but are not limited to, weightlifting, running, jumping, cardio equipment, gymnastics and bodyweight movements.

I understand that participation in these activities carries inherent risks, including falls, collisions, equipment-related incidents, muscular strains, sprains, fractures, aggravation of existing injuries or medical conditions, cardiovascular events and other serious injury. In rare circumstances, physical activity may result in permanent injury or death.

I voluntarily choose to participate in the Powered Games with an understanding of these risks.

I confirm that, to the best of my knowledge, I am physically capable of participating safely in the Powered Games.

I understand that it is my responsibility to seek medical advice before participating if I have any injury, illness, medical condition or other concern that may affect my ability to safely participate.

I agree to disclose to EmpoweredHQ any relevant injury, medical condition or limitation that may reasonably affect my safe participation.

I agree to immediately stop participating and notify an EmpoweredHQ staff member if I experience unusual or concerning symptoms, including chest pain, severe shortness of breath, dizziness, loss of consciousness or significant pain or injury.

I agree to follow all reasonable instructions provided by EmpoweredHQ staff, coaches, judges and event officials, including movement standards, competition rules and safety directions.

I understand that EmpoweredHQ may modify or stop my participation in a workout or remove me from the competition if staff reasonably believe that continuing may create an unacceptable risk to my health or safety or the safety of another person.

I agree to behave responsibly and use equipment only for its intended purpose.

I agree not to participate while impaired by alcohol, recreational drugs or any other substance that may negatively affect my ability to participate safely.

I understand that EmpoweredHQ may prevent me from participating if staff reasonably believe that I am impaired or otherwise unable to participate safely.

If I become injured, ill or otherwise require assistance during the event, I consent to EmpoweredHQ staff providing or arranging reasonable first aid and emergency assistance.

Where EmpoweredHQ reasonably considers it necessary, I authorise staff to contact emergency services and arrange ambulance transportation or other emergency medical treatment on my behalf.

I understand that I am responsible for ambulance, hospital, medical or other treatment expenses incurred on my behalf, subject to any applicable insurance or other entitlement.

I acknowledge and voluntarily accept the inherent and reasonably foreseeable risks associated with participating in the Powered Games.

To the maximum extent permitted by law, I accept responsibility for injury, loss or damage resulting from the inherent risks of my voluntary participation in the event.

To the extent permitted by applicable law, I release and indemnify Barker Health & Wellness Studios Pty Ltd trading as EmpoweredHQ, and its directors, employees, contractors, coaches, judges and event personnel, from claims arising from the inherent risks of my participation in the Powered Games.

Nothing in this waiver is intended to exclude, restrict or modify any right, consumer guarantee or liability that cannot lawfully be excluded, restricted or modified, including liability that cannot be excluded under applicable Australian Consumer Law.

I understand that I am responsible for my personal belongings during the event.

To the extent permitted by law, EmpoweredHQ is not responsible for personal belongings that are lost, stolen or damaged during the Powered Games.

I understand that this Athlete Participation Waiver applies specifically to my participation in the Powered Games.

If I am already an EmpoweredHQ member, this waiver operates in addition to any existing membership agreement, waiver or other terms I have previously accepted and does not replace those agreements.

By agreeing to this waiver I confirm that:

• I have read and understood this Athlete Participation Waiver.
• I have had the opportunity to ask questions before agreeing to it.
• The health and medical information I have provided is accurate to the best of my knowledge.
• I understand the nature and physical demands of the Powered Games.
• I understand and voluntarily accept the inherent risks associated with participating.
• I agree to comply with the event rules and reasonable safety instructions provided by EmpoweredHQ.
• I voluntarily agree to participate under the terms outlined above.
